Disclaimer

You agree to defend, indemnify and hold harmless MILKFED, FertilityFlower.com and its directors, officers, agents and employees from all liabilities, claims and expenses, including legal fees, which arise from a breach of this Agreement for which you are responsible or by your use of FertilityFlower.com.

To the maximum extent permitted by applicable law, MILKFED, FertilityFlower.com and its directors, officers, agents and employees disclaim all warranties, either express or implied including but not limited to implied warranties of merchantability, fitness for a particular purpose and non infringement. MILKFED, FertilityFlower.com and its directors, officers, agents and employees shall not be liable for any damages whatsoever, including direct, indirect, lost profits or information, business interruption, or other pecuniary loss, even if they or anyone of them have been advised of the possibility of such damage or loss.

Termination and Cancellation

Either you or MILKFED may terminate or cancel your membership at any time, with or without cause. You understand and agree that the cancellation of your account is your sole right and remedy with respect to any dispute with MILKFED or FertilityFlower.com. This includes, but is not limited to, any dispute related to, or arising out of: (1) any term of this Agreement; (2) MILKFED or FertilityFlower.com's enforcement or application of this Agreement; (3) the content available on FertilityFlower.com's web site; (4) your ability to access and/or use Fertility Flower On-Line including the revocation of your access to the Forums or any other part of the site; or (5) the amount or type of fees, surcharges, applicable taxes, billing methods, or any change to the fees, applicable taxes, surcharges or billing methods.

While you may cancel your account at any time, any purchases made (such as a Premium Membership) are non-refundable.
